NBA Boldly Rejects AGF Directive, Vows to Hold 2026 National Elections as Scheduled

In a landmark assertion of professional independence, the Nigerian Bar Association (NBA) has unequivocally rejected a purported directive from the Attorney General of the Federation and Minister of Justice, Lateef Fagbemi (SAN), aimed at postponing its 2026 national officers’ election.

The association made its position crystal clear in a statement signed by its President, Mazi Afam Osigwe (SAN).

The NBA emphasized that only its National Executive Council (NEC) holds the constitutional authority to make decisions regarding the timing or conduct of its internal elections.

The NBA became aware of a document containing recommendations from a sub-committee, along with comments attributed to the AGF.

These included directives to postpone the election, disband the Electoral Committee of the Nigerian Bar Association (ECNBA), and appoint a caretaker committee.

Describing these moves as unconstitutional and beyond the powers of the Attorney General, the NBA stressed its status as an independent professional body established by law.

It is not subject to the control or supervision of the AGF or any government arm. The Legal Practitioners Act provides only limited circumstances for external interference, none of which apply here.

The association further noted that related issues are already before the courts in ongoing litigation (stemming from Egbe Amofin cases).

It criticized the sub-committee report for exceeding its mandate and violating principles of fair hearing.

This firm stance by the NBA is being celebrated as a victory for institutional integrity and democratic governance within Nigeria’s professional associations.

By insisting that its electoral process will continue as planned, the NBA upholds transparency, due process, and self-regulation.

It has dismissed additional proposals such as changing its election service provider or introducing new requirements like the National Identification Number (NIN) mid-process, warning they could undermine the election’s credibility.

Mazi Afam Osigwe and the NBA leadership have reaffirmed their commitment to the rule of law, promising to follow constitutional processes without external dictation.
